Estimado Señor Batista:
En seguimiento de la reunión que le solicitamos al señor Federico Melo y que se realizó con el Ing. Luis A. Naar, persona designada para que nos atendiera, con quien platicamos temas importantes sobre el Residencial de Montaña Altos de Cerro Azul y posteriormente se han realizado otras reuniones en compañía del Lic. Victor De La Cruz y Lic. Publio De Gracia, en vista de que no hemos podido establecer una fecha para otra reunión, tenemos a bien pedir su gentil apoyo en aclarar la situación actual – sobre la parcelación o lotificación del Residencial de Montaña Los Altos de Cerro Azul, del cual somos propietarios.
Según nuestras investigaciones hasta la fecha, dicho proyecto ha sido registrado en el Ministerio de Vivienda y Ordenamiento Territorial, bajo los nombres de las 9 distintas etapas. Estas etapas o barriadas tienen los siguientes nombres (y algunos están divididos en dos o más partes, por ejemplo Alcázar I y Alcázar II):
Altos del Frente
Altos del Castillo
Altos del Alcazar
Altos del Vigía
Altos del Centinela
Altos de la Fortaleza
Altos del Guardián
Altos del Torreón
Altos del Fortín
Las preguntas que deseamos formularle son las siguientes:
1. Cuál es la situación actual de cada una de las 9 lotificaciones o barriadas:
• Han sido aceptadas y certificadas por el Ministerio como áreas de desarrollo privadas con infraestructuras (calles, áreas comunes, etc) ?
• En el caso que no hayan sido aceptadas como privadas, le rogamos indicarnos cuál es su situación actual y cuáles son las estipulaciones en cuanto a mantenimiento y posesión de calles y demás áreas comunes o públicas?
• En qué etapa se encuentran como proyectos – por ejemplo, se consideran como proyectos en ejecución todavía bajo el control del promotor; o como proyectos terminados por entregar?
2. Independiente de si las barriadas sean consideradas actualmente como privadas,
tendrán derecho los propietarios del Residencial de Montaña Los Altos de Cerro Azul, de pertenecer al régimen de Propiedad Horizontal bajo las estipulaciones de los numerales 3, 4 y/o 6 del artículo 2 de la Ley 31 de 2010?
Se debe tomar en cuenta de que a pesar de que se hayan dividido en 9 o más etapas con distintos nombres, las mismas en realidad conforman una sola área residencial aislada con un solo acceso a la vía pública.
3. Cuál es la situación final de las Asociaciones?

We refer to the meeting we requested with Mr. Federico Melo, that was held with Mr Luis Naar, the person designated to attend to us, with whom we discussed important matters regarding Residencial de Montaña Altos de Cerro Azul and other later meetings atended by Mr. Victor De la Cruz and Mr. Publio De Gracia. In view of the fact that we have not been able to establish the date for another meeting, we kindly request your help in clarifying the the present situation regarding the Residencial de Montaña Los Altos de Cerro Azul Project, in which we are property owners.
According to our investigations to date, this project has been registered in the Ministry of Housing and Zoning, under the names of the 9 different stages. These stages or neighborhoods have the following names (and some are divided into two or more parts, for example Alcazar I and Alcazar II):

Altos del Castillo
Altos del Alcazar
Altos del Vigía
Altos del Centinela
Altos de la Fortaleza
Altos del Guardián
Altos del Torreón
Altos del Fortín
The questions we ask are as follows:

• In the event that they have not been accepted as private, please let know us what is their current situation and what provisions exist with regard to possession of streets and other public or common areas and maintenance thereof?
• At what stage are they as projects - for example, are they considered as projects still under the control of the promoter; or as completed projects handed over to the owners?
2. Independently of whether the neigborhoods are currently considered to be private,
will the owners of Residencial de Montaña Los Altos de Cerro Azul, be eligible to belong to the Horizontal Property Regime under the provisions of the items 3, 4 and/or 6 of article 2 of Law 31 of 2010?
It is important to take into account that while the neighborhoods have been divided up into 9 or more stages with different names, they actually make up just one independent residential area with just one access to public roads.
3 What is latest situation of the Property Owners’ Associations?
