¿Donde está la administración? Ruido continuoso

Anoche llamé la garita a las 9:30 para quejar sobre la gente a la casa de mi vecino.
Ellos llegaron a las 2:30 en la mañana gritando y haciendo mucho ruido. Noche numero 1 sin dormir.
Despues de horas de musica a alto volumen y sonido de boom boom boom golpeando mi casa, anoche llamé la garita para hacer una queja. El dijo van a hablar con mi vecino. Toda la noche queda con musica a alto volumen como antes. Noche numero 2 sin dormir y en este momento, el ruido continua.

En mi opinion la administracion no trabaja para los propietarios y es el tiempo para denunciar Vistamares. Necesitamos una asociation de propietarios representando nuestro interes.

¿Que piensan ustedes?

What do believe an owner's association could do to quiet your neighbors? What do you believe Vistamares should have done? If these people are disturbing the peace, isn't that the proper jurisdiction for the police?

I have similarly experienced loud and rude neighbors. Having lived in Panama before moving to Cerro Azul, I noticed that such college frat type behavior is quite typically Panamanian. In Ohio, such behavior would result int he police providing one warning and an arrest of the offender if a second visit was required. I suspect that Panama has no such noise ordinances as it is very common, both in the city and her in Cerro Azul, for such obnoxious behavior by persons who enjoy partying as if they were college teens.

I do not know what the administration could do except to tell the neighbors that they are being rude and asking them to display some degree of courtesy. Any future home owner's association will have less clout than our friends at the gate, who at least have some rapore with most residents.

I think your only alternative is to call the police, if there exists any noise ordinance, and to request intervention by filing criminal charges. If your neighbors are Panamanian, however, I suspect that the likiehood of Panamanian authorities enforcing the law to the perceived detriment of a fellow citizen in favor of a "guest" to the host country is somewhere between slim and none (and I saw slim leave the room a while ago...) I myself experienced this treatment when a woman ran a stop sign and T-boned me as I rode my motorcycle on a highway where I clearly had right of way. She was cited for NOTHING and I was cited for, now get this..."falling in the road" as an "other or miscellaneous offense". I was more than a little agitated but I learned a valuable lesson... There is a song from my youth by a group known as Bread that has a line: "Here I am on my hands and knees; scribbing in my dungarees. I got burned, but I finally learned; THIS IS WHAT THE GOVERN...MEANT."

Our choices are but two: Live with our neighbors, the rude and the obnoxious as well as the kind and the courteous OR return to civilization as we once knew it in the land from whence we came...

just arrived here 17 Nov to live full time...already can see that after 13 Dec, the date school let out (what I believe is key to some of this), is that kids are coming to spend the summer here. I live El Castillo and there is a 'weekend rent house' several houses down had loud music as well the other day...but it finally went off.

Did anyone see that garbage thrown down right in front of the garbage place today? Wow, what disrespect in Chagres Nat'l forest...put that stuff in a bag. Guess what it was? It was shool papers....I am now seeing more beer cans on side of the road as well. Perhaps a small paper handout can be given at the gate explaining the rules to new faces. I think after a while, security knows faces. We, long term residents, have access to this type website but doubt the guests do...

Por supuesto que siempre habrá vecinos que se portan mal. Pero igualmente Melo (como Administrador) debe tomar acciones para eliminar los abusos que nosotros les reportamos. Por eso le pagamos. Melo debe pedir el apoyo de la policía si algún propietario se niega a cumplir con la ley. Desafortunadamente los empleados de Melo creen que dentro de Los Altos de Cerro Azul el cumplir leyes. La mayoría de los empleados de Melo no tienen idea de los reglamentos contenidos en el Manual del Propietario y mucho menos de su obligación de hacerlos cumplir.

Entonces qué podemos hacer para obligar al personal de Melo a hacer su trabajo? Ahora mismo, nada. Por qué? Porque Melo ha optado por no activar las Asociaciones de Propietarios (APs) que estaba obligado a formar y luego entregar a los propietarios hace más de 20 años. Melo insiste en seguir ocupando el 100% de los puestos en las juntas directivas de las APs y a la vez es Administrador del proyecto. Éste, además de ser una falla estructural básica, es un conflicto de interés y es ilegal. Como propietarios estamos sin poder de defender nuestros derechos básicos o (de la otra mano) apoyar efectivamente a Melo cuando trata de hacer algo correcto (por ejemplo, cobrar cuentas morosas). Dependemos totalmente de lo que Melo decida hacer o no hacer. No tenemos voz ni voto. Vivimos en una dictadura!

En cualquier estructura legal correcta de propiedad privada compartida, el Admistrador responde a los derechos y deseos de los propietarios por medio de su AP, y al mismo tiempo la AP apoya al Administrador cuando éste tiene problemas con cualquier propietario recalcitrante. Y la potestad de tomar acción legal pertenece a la AP. A eso se refiere Steve. Ahora mismo no tenemos poder para defender nuestros intereses comunes porque para todos los efectos las Asociaciones de Propietarios no son de nosotros. Como resultado, el proyecto se está deteriorando en todos los respetos.

Of course we shall always have problems with badly-behaved neighboors. But equally Melo staff should act to stop abuses we report to them. As Administrator, that’s what they are supposed to do. That’s what we pay them for. They can call on police support if anyone refuses to obey the law. Unfortunately they seem to think that implementing laws and national park regulations within Altos de Cerro Azul is optional, and depends on their mood at the time – sometimes they act, sometimes they don’t. Most Melo staff seem to have no idea what the rules and regulations are (mostly contained in the highly accessible Manual del Propietario), nor of their duty to make sure they are complied with.

So what can we do to oblige Melo staff to do their job? Right now, nothing. Why? Because Melo has chosen not to activate the Property Owners Associations (POAs) they were obliged to set up and should have handed over to the residents more than 20 years ago. Melo insists on continuing to occupy 100% of the positions on the POA Boards of Directors and at the same time Melo is Administrator. That’s not only a basic flaw, it’s also a conflict of interest and what’s more it’s illegal. It leaves us powerless to protect our basic rights and interests or (on the other hand) support Melo when they do something right. We depend totally on and have no say in what Melo decides. We live in a dictatorship!

In any normal and legal co-property set-up, the Administrator answers to the POA and at the same time the POA supports the Administrator when he encounters problems with individual owners. The POA has the ultimate legal power to act. That’s what Steve is getting at. We are powerless at present to protect our shared rights because for all effects the POAs don’t belong to us. As a result the project is deteriorating in all senses.

PS There are noise ordinances in effect for Los Altos de Cerro Azul.

Melo y ANAM elaboraron el Manual Ambiental de Propietarios el año pasado, con reglas especificas como la prohibición del ruido excesivo.
Quién debe hacer respetar este reglamento interno de Los Altos de Cerro Azul? La Administracion, NO la Policía.

Pero parece que a la Administración no le importa ni las reglas ni las leyes, ni los propietarios.

Como dice Avechaser, estamos en una forma de "dictadura" donde, como en todas las dictaduras de la Historia, los "juega vivos" aprovechan del desorden, la gran mayoría agachan la cabeza para no ver ( porque es lo mas fácil), y unos pocos "disidentes" tratan de hacer valer sus derechos, para el bien de la comunidad.....

Me parece que lo que escribió avechaser es precisamente el punto primordial por la cual lo propietarios de Altos de Cerro Azul hemos estado quejandonos. No tenemos derechos ni opiniones en esta estructura, solamente obligaciones. Es tiempo que esto empiece a cambiar y que la Administración se comporte como una verdadera empresa al servicio de los propietarios!

En cuanto a los ruidos escandalosos de vecinos, las prácticas de disparos al aire libre, la basura que botan fuera del recinto, los perros sueltos de los cuida-casas y los fuegos artificiales en Cerro Azul; los Estatutos de las Asociaciones y el Manual del ANAM le otorgan todo el derecho al Administrador de tomar acciones enérgicas contra estas violaciones. Estoy pagando por un servicio y quiero que estas cosas se corrijan!

Hi everyone,
It seems to me that what avechaser wrote, is precisely the main issue why Altos of Cerro Azul owners are complaining about. We have no rights and no sayings about how things are handled in this community, only obbligations. It´s time to change and have an Administration behaving as a truely service company to us owners!.

Regarding the loud noises from obnoxios neighboors, gun firing practice, garbagge thrown outside of the conteiner, stray dogs belonging to house-caretakers and firing fireworks in Cerro Azul; the Association´s By-Laws and ANAM´s Manual give the Administrator all the rights to take strong actions against these violations. I´m paying a TSM fee and I want these things to be corrected!

Si todos estamos siendo molestados al parecer por las mismas personas y sus mascotas, y soy muy conciente que el problema no es la mascota. Yo en lo personal siempre traigo mis perros y les tengo un patio cercado epecialmente para ellos, sin embargo siempre encuentro huellas y excremento de perros en mi jardin y hortalizas, cosa que no me agrada para nada. Cuidamos nuestras plantas igual que nuestras mascotas y considero injusto que cada ves que me ausente me encuentro con algun daño causado por irresponsabilidad de supuestos cuidadores. Si les permiten tener mascotas, entonces que lo hagan responsablemente o no las tenga. Yo he tenido que evitar atropellar cientos de veces a un perro blanco y negro que salta a nuestro auto cada ves que llego a mi casa.
Al menos, sobre este punto pienso ir donde el admistrador en cuanto vuelva a cerro azul.
